Terms of Service

These Terms govern your access to and use of https://solematesclub.co (the “Site”) and the SoleMates Collector Club digital collectibles experience (the “Service”), operated by Sole Mates Club (“we,” “us,” or “our”). By entering the Site, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms form a binding agreement between you and Sole Mates Club. We may update them from time to time as described in Section 21.

2.

Eligibility & Age Requirement (18+)

The Service is intended only for adults aged 18 or older (or the age of majority in your jurisdiction, if higher). By using the Service you represent and warrant that you are at least 18 and that you have the legal capacity to enter into these Terms. We use an age-confirmation gate; falsifying your age is a violation of these Terms, and we may suspend or terminate access if we believe a user is under 18.

Adult Content Notice

The Site features mature, adult-oriented themed content. By entering, you confirm that such content is legal to view where you live and that you are voluntarily choosing to access it. All individuals depicted in any content on the Site were at least 18 years of age at the time the content was created. If adult content is prohibited in your location, you must not use the Service.

The Service & Digital Collectibles

SoleMates Collector Club is a digital collectibles experience for entertainment purposes. Cards, mystery packs, collections, badges, and the collector binder are digital items delivered to your account. They are not physical goods, are not cryptocurrency, NFTs, securities, or financial instruments, and are not an investment of any kind.

Digital cards are claimed by scanning a unique QR code (or entering a code) tied to an item you obtained, then signing into your account. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and display your digital items within the Service. We may add, change, retire, or modify cards, collections, packs, odds, and features at any time.

5.

Accounts

• You must provide accurate information when creating an account and keep it up to date.
• You are responsible for your login credentials and all activity under your account. Keep your password confidential.
• One person, one account, unless we expressly permit otherwise. Do not share, sell, or transfer your account.
• Notify us promptly at yoursolecollector@gmail.com of any unauthorized use.
• We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent, abusive, or operated by a minor.

Purchases & Payments

Purchases of packs, cards, or related items are processed by our third-party platform, FeetFinder, and/or other payment providers we designate. We do not collect or store your full payment card details. All purchases are also subject to the terms and policies of the platform processing them. Prices, availability, and pack contents may change at any time. You are responsible for any applicable taxes. Completing a purchase does not create any ownership interest beyond the limited license described in Section 4.

7.

Mystery Packs, Odds & Randomized Items

• Mystery packs contain a randomized assortment of digital cards. You are purchasing the pack and the chance to receive certain cards — not any specific card.
• Any published pull rates or odds are good-faith estimates and may be approximate. Outcomes are determined randomly and are not guaranteed.
• Packs are sold for entertainment. Digital cards have no cash value and cannot be exchanged for money (see Section 8). The Service is not gambling and no real-money prizes are awarded by the randomization itself.
• You must not purchase packs where randomized digital goods are restricted or prohibited by law. Where required, this feature is void where prohibited.

8.

Digital Items Have No Monetary Value

Digital cards, badges, points, and other virtual items have no real-world monetary value, are not redeemable for cash, and are not your property — they are a limited license granted to you. You may not sell, auction, or transfer digital items for real currency outside features we expressly provide. We may modify, suspend, or remove digital items, and these items may be lost if your account is terminated or the Service is discontinued.

9.

Redemption Cards & Rewards

Certain rare cards (for example, the “Peach Pass,” “Signature,” or similar inserts) may be redeemable for a described reward, such as custom digital content. To redeem, follow the instructions on the card or in your account and provide any details we reasonably need to fulfill it. Rewards are subject to the following:

• Rewards are personal to the redeeming account holder and are non-transferable unless we state otherwise.
• Fulfillment may take a reasonable amount of time; we will make commercially reasonable efforts to deliver as described.
• We may set reasonable limits, substitute a reward of comparable value if a described reward becomes unavailable, and decline redemptions that appear fraudulent or abusive.
• Redemption rights may expire as stated at the time of issue. Any custom content delivered is also a limited license for personal use and may not be resold or redistributed.

10.

Trading

If we offer trading features, you may trade digital cards with other users only through tools we provide and subject to any rules we set. You may not trade outside the Service, trade for real money, or use trading to launder, defraud, or harass. We may limit, reverse, or disable trades to prevent abuse.

11.

Refunds

Because the Service delivers digital items immediately, all sales are generally final and non-refundable, except where required by law or by the policy of the platform that processed your payment (such as FeetFinder). If you believe a charge was made in error, contact us at yoursolecollector@gmail.com and the platform that processed the payment.

12.

Acceptable Use

You agree not to:

• Use the Service if you are under 18 or circumvent the age gate;
• Copy, reproduce, screenshot for redistribution, scrape, data-mine, or republish any cards, images, or other content except for your own personal, non-commercial use;
• Resell, sublicense, or commercially exploit any content or digital items;
• Reverse engineer, interfere with, overload, or attempt to gain unauthorized access to the Service;
• Use bots, scripts, or automated means to open packs, claim cards, or create accounts;
• Upload malware, harass others, or use the Service for any unlawful purpose;
• Impersonate us or misrepresent your affiliation.

13.

Intellectual Property

The Service and all content — including card artwork, photographs, characters, names, logos, designs, text, and the SoleMates Collector Club brand — are owned by Sole Mates Club or its licensors and are protected by intellectual property laws. We grant you only a limited, personal, revocable license to view your digital items within the Service. No other rights are granted. You may not use our trademarks or content without our prior written permission.

14.

Your Submissions

If you submit information or requests (for example, to redeem a reward), you represent that you have the right to do so. You grant us a non-exclusive license to use that information as needed to operate the Service and fulfill your requests. Do not submit anything unlawful or that infringes others’ rights.

15.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what we collect and how we use it. By using the Service, you consent to those practices.

16.

Third-Party Services & Links

The Service relies on and links to third parties such as FeetFinder (payments), our email and hosting providers, and analytics tools. We do not control and are not responsible for third-party services, their content, or their policies. Your dealings with them are governed by their own terms.

17.

Disclaimers

THE SERVICE AND ALL DIGITAL ITEMS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any particular card or reward will be available.

18.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Sole Mates Club WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR DIGITAL ITEMS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $100.

19.

Indemnification

You agree to indemnify and hold harmless Sole Mates Club and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

20.

Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. On termination, your license to use the Service and any digital items ends. Sections that by their nature should survive (including IP, disclaimers, liability limits, and indemnification) will survive.

21.

Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide notice. Your continued use after changes take effect constitutes acceptance.

22.

Governing Law & Dispute Resolution

These Terms are governed by the laws of [MN/USA], without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us at yoursolecollector@gmail.com to try to resolve it informally. Any disputes will be resolved in the courts located in [USA, MN/USA], and you consent to their jurisdiction.

23.

General

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
